Terms & Conditions
Clear general terms for using this website and working with Red Calabash.
LAST UPDATED: 10 AUGUST 2026
Important: project quotations, proposals and specific service agreements may contain additional terms and will govern the particular work where they differ from these general website terms.
1. About these terms
These Terms & Conditions apply to use of the Red Calabash website and provide general terms for enquiries and services. Specific quotations, proposals, service schedules, project agreements or other written agreements may contain additional or different terms.
2. Website information
We aim to keep the information on this website accurate and useful, but service descriptions, availability, pricing and other information may change. A final quotation or written agreement confirms the actual scope and commercial terms of a client engagement.
3. Quotations and project scope
Work is performed according to an agreed scope. Requirements outside that scope, including additional design, development, functionality, content, integrations or other work, may require additional fees or a separate quotation.
4. Pricing
Published prices are intended to provide clear starting points. Where a service is described as 'from' a particular amount, the final price depends on the actual scope. Red Calabash is currently not VAT registered.
5. Payments
Payment terms are confirmed in the applicable quotation, proposal, invoice or service agreement. Work may be scheduled, paused or withheld where agreed payments are overdue.
6. Client responsibilities
Clients are responsible for providing accurate information, content, approvals, access and other materials reasonably required to complete or support the agreed work. Delays in receiving required information may affect project timelines.
7. Hosting and Website Care
Hosting provides the infrastructure required to keep a website online. Website Care is a separate ongoing service that may include maintenance, checking and technical support according to the selected plan. New development is not automatically included in Website Care.
8. Third-party services
Websites and digital services may rely on third-party platforms, software, hosting providers, payment services, APIs or other external systems. Red Calabash is not responsible for interruptions or changes caused solely by independent third-party providers, although we may assist where this forms part of an agreed service.
9. Intellectual property
Ownership and usage rights for project work are governed by the applicable quotation, proposal or project agreement. Third-party software, fonts, stock assets, plugins, platforms and licensed materials remain subject to their own licence terms.
10. Support and additional work
Support requests should use the available Red Calabash support channels. Straightforward additional work may be billed at the applicable hourly rate. Larger additions, new functionality or substantial changes may require a separate scope and quotation.
11. Limitation and reasonable care
Red Calabash will use reasonable professional care in providing agreed services. To the extent permitted by law, Red Calabash cannot guarantee uninterrupted availability of internet-based services or outcomes dependent on third-party systems, search engines, social platforms, advertising platforms or factors outside our reasonable control.
12. Privacy
Personal information is handled in accordance with applicable South African privacy law and the Red Calabash Privacy Policy and POPIA & Privacy Notice.
13. Changes
These general terms may be updated as Red Calabash services and legal requirements change. Project-specific agreed terms remain governed by the applicable written agreement.
